The People's Republic of China Ministry of Commerce and General Administration of Customs Announcement No. 100 of 2008 "2009 Export License Management Goods Catalog"

In accordance with the Foreign Trade Law of the the People's Republic of China of China and the Regulations on the Administration of the Import and Export of the People's Republic of China Goods, the Catalogue of Goods Subject to Export License Administration in 2009 (see Annex 1) is hereby issued, and the relevant issues are announced as follows:

1. 50 kinds of goods that will be subject to export license management in 2009 will be subject to export quota license, export quota bidding and export license management respectively.

(I) goods subject to export quota license management are: corn, rice, wheat, corn flour, rice flour, wheat flour, cotton, sawn timber, live cattle (for Hong Kong and Macao), live pigs (for Hong Kong and Macao), live chickens (for Hong Kong and Macao), coal, coke, crude oil, refined oil, rare earth, antimony and antimony products, tungsten and tungsten products, zinc ore, tin and tin products, silver, indium and indium products, molybdenum and phosphorus ore.

(II) goods subject to export quota bidding are: rush and rush products, silicon carbide, fluorine stone (powder), talcum (powder), light (heavy) burned magnesium, bauxite, licorice and licorice products.

(III) goods subject to export licensing are: live cattle (for markets outside Hong Kong and Macao), live pigs (for markets outside Hong Kong and Macao), live chickens (for markets outside Hong Kong and Macao), chilled beef, frozen beef, chilled pork, frozen pork, chilled chicken, frozen chicken, ozone-depleting substances, Paraffin, zinc and zinc-based alloys, some metals and products, platinum (exported by processing trade), automobiles (including complete sets of parts) and their chassis, motorcycles (including ATVs) and their engines and frame, natural sand (including standard sand), molybdenum products, citric acid, vitamin C, penicillin industrial salt, disodium sulfate.

In addition to the country (region) quota license management under the global license for live cattle, live pigs and live chickens exported from Hong Kong and Macao, the 2. shall implement the global export license management for all the export goods listed in the export license management goods catalogue. Except for the export of natural sand to Hong Kong, Macao and Taiwan, export is prohibited in other regions; global export license management is implemented for standard sand.

The 3. implements state-owned trade management on corn, rice, coal, crude oil, refined oil, cotton, antimony and antimony products, tungsten and tungsten products, and silver.

4. goods subject to export quota bidding, regardless of the mode of trade, each authorized issuing agency shall issue an export license on the basis of the list of winning enterprises issued by the Ministry of Commerce and the number of winning bids and the Certificate of Export License for Goods Subject to Quota Bidding issued by the Bidding Office.

The export of the following goods by 5. in the form of processing trade shall be handled in accordance with the following provisions:

If a (I) exports goods subject to export quota license administration in the form of processing trade [except as provided for in the (II), (III), (IV) and (V) paragraphs of this article], the license issuing agency shall issue an export license on the basis of the export quota, the Processing Trade Business Approval Certificate and the export contract (copy of the original).

(II) import raw materials used for the production of platinum processing re-export platinum (platinum or platinum), the issuing agency shall issue an export license on the basis of the "Processing Trade Business Approval Certificate" of the competent commercial department of the place where the business enterprise is registered, the customs import declaration form for processing trade, and the export contract (original copy).

(III) import crude oil processing re-export paraffin wax, import silver-containing goods (except silver powder, unforged silver, etc. and silver semi-manufactured products) processing re-export silver, export zinc and zinc-based alloys in the form of processing trade, the issuing agency shall issue an export license on the basis of the "Processing Trade Business Approval Certificate", customs processing trade import declaration form and export contract (original copy) issued by the provincial commercial department of the place where the business enterprise is registered. Among them, the Silver "Processing Trade Business Approval Certificate" is issued with the approval of the Ministry of Commerce, and the issuing department plus the approval of the Ministry of Commerce.

(IV) export licorice and licorice products in the form of processing trade, the license issuing agency shall issue the export license on the basis of the processing trade business approval certificate of the provincial commerce department of the place where the business enterprise is registered, the certificate of application for export license of processing trade goods issued by the China Chamber of Commerce for import and export of medical and health products, the customs import declaration form for processing trade and the export contract (original copy).

(V) imported crude oil processing re-export of refined oil, exempt from the export license of refined oil. Regarding the export of lubricating oil (grease) and lubricating oil base oil under processing trade, the relevant provisions of the Announcement No. 30 of the Ministry of Commerce, the Development and Reform Commission, and the General Administration of Customs in 2008 shall be implemented.

(VI) the validity period of the export license mentioned in the (I), (II), (III) and (IV) paragraphs of this article shall be issued in accordance with the export period approved by the Processing Trade Business Approval Certificate, but shall not exceed December 31 of the current year. If the export period approved by the Processing Trade Business Approval Certificate exceeds December 31 of the current year, the operator shall renew the new year's export license to the issuing agency within the validity period of the original export license, the issuing agency shall withdraw the original license, cancel the original license in the issuing system, and reissue the new year's export license according to the export period approved by the Processing Trade Business Approval Certificate after deducting the used quantity, and indicate the original license number in the remarks column.

6. In accordance with the spirit of the State Council's "Notice on Issues Related to Border Trade" (Guo Fa [1996] No. 2), small border trading enterprises that export quota bidding goods, ozone-depleting substances, automobiles (including complete sets of parts) and their chassis, Motorcycles (including all-terrain vehicles) and their engines and frames shall still apply for export licenses at the license issuing agencies authorized by the Ministry of Commerce in accordance with the current relevant regulations. Border small trade enterprises export border small trade export license management goods (Annex 2 1-28), authorized by the Ministry of Commerce of the border provinces and autonomous regions in accordance with the border small trade export quota issued by the Ministry of Commerce issued an export license. The export of goods listed in the 2009 Export License Management Goods Catalog, except those mentioned in this article, shall be exempted from export licenses.

7., in order to ensure the implementation of the online verification of import and export licenses, for goods that do not implement the management of "one batch, one license", the issuing agency must fill in the "non-batch, one license" column of the license when issuing the export license ".

The goods under the management of "non-one batch, one certificate" are:

(I) foreign-invested enterprises to export goods;

Export goods (II) processing trade;

Export goods under (III) compensation trade;

(IV) rice, corn, wheat, live cattle, live pigs, live chickens, beef, pork, chicken, crude oil, refined oil, coal, automobiles (including complete sets of parts) and their chassis.

The export license of "not one batch, one license" may be declared at the same port for multiple times, but not more than 12 times. When the twelve customs declaration, although the export license has a balance, the customs stop accepting customs declaration.

9. enterprises shall apply for export licenses for exporting automobile products in the form of general trade, processing trade, border trade and donation trade; enterprises shall apply for export licenses for exporting automobile products in the form of project contracting, but they are not subject to export qualification management restrictions.

10. the products in this catalogue provided by our government under foreign aid are not included in the quota and license management.

11. Any commodity listed in the catalogue of goods subject to export prohibition, export quota license or export license management shall be managed in accordance with the management method of the original customs commodity number if the commodity number is changed due to the addition, mixing of other ingredients, or simple processing.

12. Where the components of the commodities declared for export contain (added or mixed) commodities that are prohibited from export, export quota license and export license management (precious metals exceed 2% and other commodities exceed 10%), they shall be managed in accordance with the management method that contains commodities that are prohibited from export, export quota license and export license management. If the existing management regulations clarify this issue, it shall still be implemented in accordance with the relevant management regulations.

Thirteen, since January 1, 2009, cancel the cocoon and part of the silk export quota license management.

This catalogue will be implemented as of January 1, 2009. The 2008 Catalogue of Goods under Export License Administration shall be repealed at the same time.
