Announcement of the Ministry of Commerce No. 124 of 2008 Issuing the Catalogue of Graded Issuing of Goods under Export License Administration in 2009

In accordance with the Measures for the Administration of Export License for Goods (Order No. 11 of 2008 of the Ministry of Commerce) and the Catalogue of Goods Subject to Export License Administration in 2009 (Announcement No. 100 of 2008 of the Ministry of Commerce and the General Administration of Customs), the Catalogue of Goods Subject to Export License Administration in 2009 is hereby issued (see Annex), and the relevant issues are announced as follows:
The 1. implemented export license management for a total of 50 kinds of goods in 2009. The Quota License Bureau of the Ministry of Commerce (hereinafter referred to as the License Bureau), the local special commissioner offices of the Ministry of Commerce (hereinafter referred to as the special office) and the local commerce authorized by the Ministry of Commerce The competent department (hereinafter referred to as the local issuing agency) is responsible for issuing export licenses for the corresponding goods.
The (I) Licensing Bureau is responsible for issuing export licenses for the following six types of goods: corn, wheat, cotton, coal, crude oil, and refined oil.
The (II) Special Office is responsible for issuing export licenses for the following 33 types of goods: rice, corn flour, wheat flour, rice flour, sawn timber, live cattle, live pigs, live chickens, coke, rare earths, antimony and antimony products, tungsten and tungsten products, zinc ore, tin and tin products, silver, indium and indium products, molybdenum and phosphate rock; rush and rush products, silicon carbide, fluorine stone (powder), talc (powder), light (heavy) burned magnesium, bauxite, licorice and licorice products; chilled beef, frozen beef, chilled pork, frozen pork, chilled chicken, frozen chicken, platinum (exported by processing trade), natural sand (including standard sand).
(III) local issuing agencies are responsible for issuing export licenses for the following 11 types of goods: ozone-depleting substances, paraffin, zinc and zinc-based alloys, some metals and products, automobiles (including complete sets of loose parts) and their chassis, motorcycles (including all-terrain vehicles) and their engines and frames, molybdenum products, citric acid, penicillin industrial salts, vitamin C, disodium sulfate.
Export licenses for 2. centrally administered enterprises in Beijing are issued by the Licensing Bureau.
In order to maintain the normal business order, the 3. shall, for some export goods, issue certificates by designated license issuing agencies or declare at designated ports for export. Enterprises exporting such goods must apply for an export license from the designated licensing agency and declare for export at the designated port; the licensing agency must issue an export license at the designated port.
(I) Antimony and Antimony Products Designated Huangpu Customs, Beihai Customs, Tianjin Customs as customs declaration port.
The export license for (II) light (heavy) magnesium burning is issued by the Dalian Special Office, designating Dalian (Dayaowan, Yingkou, Bayuquan, Dandong, Dadonggang), Qingdao (Laizhou Customs), Tianjin (Donggang, Xingang), Changchun (Tumen) and Manzhouli as customs ports.
Licorice (III) designates Tianjin Customs, Shanghai Customs and Dalian Customs as customs declaration ports; Licorice products designates Tianjin Customs and Shanghai Customs as customs declaration ports.
(IV) export licenses for live cattle, pigs and chickens exported by land transport to Hong Kong and Macao shall be issued by the Guangzhou Special Office and the Shenzhen Special Office.
(Inner Mongolia Autonomous Region) Designated Manzhouli, Erlianhot, Dalian, Tianjin and Qingdao as customs declaration ports and issued export license by the Department of Commerce of Inner Mongolia Autonomous Region; (Xinjiang Uygur Autonomous Region) Designated Alashankou, Tianjin and Shanghai as customs declaration ports and issued export license by the Department of Commerce of Inner Mongolia Autonomous Region; (Xinjiang Uygur Autonomous Region) Designated Alashankou, Tianjin and Shanghai as customs declaration ports and issued export license by the Department; (Fujian Province) Fuzhou, Xiamen, Putian and Zhangzhou are designated as customs declaration ports, and the export license is issued by the Fujian Provincial Department of Foreign Trade and Economic Cooperation.
The (VI) standard sand export license is issued by the Fuzhou Special Office; the natural sand export license for Hong Kong and Macao is issued by the Guangzhou Special Office; the natural sand export license for Taiwan is issued by the Guangzhou Special Office and the Fuzhou Special Office (respectively to Guangdong Province and Fujian Province Enterprises that meet the application standards for natural sand export licenses) are issued and declared for export at the ports of the province.
4. in accordance with the provisions of the "Administrative Measures for the Pilot Export of Imported Log Processing Sawn Timber" (Lin Jfa [2001] No. 560) jointly issued by the State Forestry Administration, the Ministry of Foreign Trade and Economic Cooperation and the General Administration of Customs in 2001, if a pilot enterprise with business qualifications imports log processing sawn timber for re-export, it must apply for an export license from the licensing agency listed in Item (V) of Article 3 of this announcement on the "Export Certificate of the Import, the issuing authority shall indicate" imported log processing sawn timber "in the remarks column of the license".
5. For goods subject to the administration of export quota bidding, the issuing agency shall issue an export license on the basis of the list of winning enterprises published by the Ministry of Commerce and the number of winning bids and the Certificate of Export License for Goods Subject to Quota Bidding issued by the bidding office.
Since January 1, 2009, the 6. has implemented export quota license management for phosphate rock, and its export license is issued by the special office; it has implemented export license management for penicillin industrial salt, vitamin C, and disodium sulfate, and its export license It is issued by the local issuing agency.
Since January 1, 2009, the 7. has canceled the export license management of some steel products in silk and some metals and products, and enterprises no longer need to apply for export licenses for customs declaration.
8. since January 1, 2009, the export license of indium and indium products and molybdenum has been adjusted to be issued by the special office.
The issuance of export licenses for processing trade and small-scale border trade by the Ministry of 9. shall be implemented in accordance with the provisions of Announcement No. 100 of 2008 of the Ministry of Commerce and the General Administration of Customs.
10. For goods that do not implement the "one batch, one certificate" management, the issuing agency must indicate "non-one batch, one certificate" in the license remarks column ".
11. The issuing agency shall issue an export license in strict accordance with the relevant provisions of the Measures for the Administration of Export License of Goods promulgated by the Ministry of Commerce, the 2009 Export License Management Goods Catalog and the Export License Issuance Work Code (2008 No. 398).
This catalogue will be implemented as of January 1, 2009. The 2008 License Issuing Agency Catalogue (Export) shall be repealed simultaneously.
